“Zilal Podcast“ Hosts Dr. Fadl Murad to Discuss the Methodology of Contemporary
Jurisprudence and Foundational Questions
The Zilal Podcast, affiliated with the
Rawasikh Center, recently featured a distinguished episode with His Excellency
Prof. Dr. Fadl Murad, Assistant Secretary-General of the International Union of
Muslim Scholars, Professor of Jurisprudence and Contemporary Issues, and
founder of the Fiqh of the Age project – a methodology for jurisprudential
analysis.
During a rich, nearly three-hour-long
discussion, Dr. Murad presented a clear methodological perspective on the
distinction between genuine scholarly mastery and the mere accumulation of
academic titles. He outlined practical steps for moving from engaging with
ready-made jurisprudential rulings (fatwas) to mastering the process of
deriving rulings independently (ijtihad).
Dr. Murad also mapped the landscape of
contemporary jurisprudential analysis, highlighting the seven foundational
questions of ta’sis (principling) and tanzil (application) that every scholar
examining modern issues must understand, regulate, and employ in both
comprehensive and detailed jurisprudential construction.
The episode further explored the story
behind the Fiqh of the Age project – its origin and purpose – as well as the
Encyclopedia of Landmarks in Contemporary Jurisprudence, explaining its
development methodology and scholarly significance.
Dr. Murad reviewed the seven key questions
in detail, starting with:
·
The Question of the
Analyst: how to achieve scholarly mastery and the “sevenfold” path of knowledge
and acquisition;
·
The Question of
Conceptualization: and the skills required to realize it;
·
The Question of
Verification: along with its sixty defining parameters;
·
The Question of the Law
of Indication: and its seven stages in analyzing contemporary issues;
·
The Question of Balances:
including hierarchical, textual, and interest-based considerations;
·
The Question of
Application: with its eleven regulatory guidelines;
·
The Question of Final
Production: and the mechanisms for deriving rulings from the Qur’anic and
Prophetic texts.
This episode represents a significant
addition to contemporary jurisprudential content, providing a practical guide
for researchers and students to understand the mechanisms of ijtihad and the
construction of jurisprudential reasoning on modern issues.
