Peer-Reviewed
Scientific Study Examines the Legal Liability of Artificial Intelligence in the
Healthcare Sector from a Jurisprudential and International Legal Perspective
Dr. Mundhir
Al-Qudah, a member of the International Union of Muslim Scholars, participated
on Saturday, 20 December, in the proceedings of the peer-reviewed International
Scientific Conference entitled: “Legal Liability for the Use of Artificial
Intelligence in the Healthcare Sector: Challenges and Prospects for
Regulation.” The conference was held at the Regency Palace Hotel in Amman,
Hashemite Kingdom of Jordan, and was organized by Amman Arab University, with
the participation of a distinguished group of academics and specialized
researchers from within Jordan and abroad.
Dr. Al-Qudah’s
participation took the form of a joint scientific paper presented with His
Excellency Professor Dr. Numan Al-Khatib, entitled: “Rules Governing Civil
Liability for the Use of Artificial Intelligence in the Healthcare Sector and
the Principles of Compensation for Resulting Harm: A Comparative Study in
Islamic Jurisprudence and International Conventions and Treaties.” The paper
was presented within the fourth thematic track of the conference, which focused
on civil, criminal, and disciplinary liability.
The paper was
presented during the first session of the conference and addressed the legal
and Shariah framework governing the use of artificial intelligence applications
in the healthcare field. It outlined the foundations of civil liability arising
from damages caused by the misuse of these applications, as well as the
controls governing compensation for such damages, in light of Islamic
jurisprudence and the provisions set forth in relevant national legislation,
international conventions, and treaties.
The study emphasized
the importance of achieving a balance between keeping pace with the rapid
technological advancement in the field of artificial intelligence and
protecting human rights and ensuring patient safety, through the establishment
of clear legal and legislative frameworks regulating the use of these modern
technologies in the healthcare sector.
