German Court Upholds Rejection
of Veiled Woman’s Appointment as Judge or Public Prosecutor in Hesse

 

A German administrative court in the city of
Darmstadt recently rejected an objection filed by a veiled woman after her
application for a position as a judge or public prosecutor in the state of
Hesse was denied
.

The court ruled that the decision by Hesse’s
Ministry of Justice to reject the applicant’s request was “correct,” noting
that the wearing of any religious attire by judges or public prosecutors
conflicts with the principle of religious and ideological neutrality within
judicial institutions
.

The court emphasized that the possibility to
appeal the decision remains available
.

The case dates back to the job interview,
during which the applicant—a Muslim who considers the headscarf a religious
obligation—stated that she was unwilling to remove it. This led the appointment
committee to reject her application, viewing the headscarf as a “religious
symbol,” after which the case proceeded to the judiciary
.
