Is there any difference between equity and justice?<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">Equity <em>&ndash; qist &ndash;&nbsp; <\/em>means manifesting justice by upholding fairness between parties, such that people are given their due rights, and they fulfill their obligations to others.<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">The Arabic verb <em>qasata<\/em> means <em>was equitable. Qasata<\/em> is the past tense verb, <em>yaqsitu<\/em> means to be just in the present, and <em>qist<\/em> is the base form. <\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">However, the same word &ndash; <em>qasata<\/em> &ndash; also means <em>was<\/em> <em>inequitable<\/em>. This is because <em>qasata<\/em> is a word with two opposite meanings.<a href=\"#_ftn1\" name=\"_ftnref1\" title=\"\"><sup><sup><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Calibri&quot;,sans-serif\"><span style=\"color:black\">[1]<\/span><\/span><\/span><\/sup><\/sup><\/a> For example, it means <em>equitable<\/em> in the verse <\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3e<\/span><\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"color:black\">That people may uphold justice (<em>quist)<\/em><\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3f<\/span><\/span><\/span> <span style=\"font-size:12.0pt\"><span style=\"color:black\">(Holy Quran 57: 25). Q<em>asitun<\/em> here means <em>those who are inequitable or unjust<\/em>, as they are compared to Muslims in the preceding verse <\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3e<\/span><\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"color:black\">Among us are those who are submitting (Muslims), and among us are the unjust. As for those who have submitted&mdash;it is they who pursue rectitude. But as for the unjust, they will be, for Hell, kindling<\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3f<\/span><\/span><\/span> <span style=\"font-size:12.0pt\"><span style=\"color:black\">(Holy Quran 72: 14-15).<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><em><span style=\"font-size:12.0pt\"><span style=\"color:black\">Aqsata<\/span><\/span><\/em><span style=\"font-size:12.0pt\"><span style=\"color:black\"> and its derivatives mean <em>equity.<\/em> The first letter in <em>aqsata<\/em> is called <em>hamzat alizala<\/em>, and it is a letter which is added to a verb to reduce the effect of the meaning conveyed by the verb. <\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3e<\/span><\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"color:black\">Once it has complied, reconcile between them with justice, and be equitable. Surely Allah loves the equitable<\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3f<\/span><\/span><\/span> <span style=\"font-size:12.0pt\"><span style=\"color:black\">(Holy Quran 49: 9). <em>Be equitable<\/em> &ndash; <em>aqsitu<\/em> &ndash; in this verse means to achieve justice and put an end to any inequity.<a href=\"#_ftn2\" name=\"_ftnref2\" title=\"\"><sup><sup><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Calibri&quot;,sans-serif\"><span style=\"color:black\">[2]<\/span><\/span><\/span><\/sup><\/sup><\/a><\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">Justice and equity complement each other. The former is the desired outcome of having authority, and the latter means uprooting all factors that lead to inequity. Imam Al-Razi, commenting on the above-mentioned verse, says, <em>iqsat<\/em> means putting an end to injustice, and <em>qasit<\/em> means someone who is unjust or inequitable.<a href=\"#_ftn3\" name=\"_ftnref3\" title=\"\"><sup><sup><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Calibri&quot;,sans-serif\"><span style=\"color:black\">[3]<\/span><\/span><\/span><\/sup><\/sup><\/a><\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">More evidence for this difference in meaning can be found in the following verse, which explains how to uproot injustice in the Muslim community, as Allah says: <\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3e<\/span><\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"color:black\">The believers are brothers, so reconcile between your brothers, and remain conscious of God, so that you may receive mercy<\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3f<\/span><\/span><\/span> <span style=\"font-size:12.0pt\"><span style=\"color:black\">(Holy Quran 49: 10<\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\"><span style=\"color:black\">).<\/span><\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">This verse presents five ways to uproot inequity:<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><strong><span style=\"font-size:12.0pt\"><span style=\"color:black\">\u2460 <\/span><\/span><\/strong><span style=\"font-size:12.0pt\"><span style=\"color:black\">True brotherhood which is based on complete faith in the Almighty. It also entails giving all brothers in Islam their due rights equitably. This brotherhood should be ideal, to the extent that Muslims feel that they all form one coherent whole.<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><strong><span style=\"font-size:12.0pt\"><span style=\"color:black\">\u2461 <\/span><\/span><\/strong><span style=\"font-size:12.0pt\"><span style=\"color:black\">Reconciliation<strong> <\/strong>between parties involved in disputes, which can be done by encouraging believers to give each other their due rights and convincing them to forgive each other.<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><strong><span style=\"font-size:12.0pt\"><span style=\"color:black\">\u2462 <\/span><\/span><\/strong><span style=\"font-size:12.0pt\"><span style=\"color:black\">There must be individuals responsible for reconciliation.<strong> <\/strong>They encourage filial relationships between Muslims, so that the devil cannot sow conflict between them, and therefore Muslims can be in peace and harmony.<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\">\u2463 Ridding one&rsquo;s self of enmity can be achieved through belief in Allah and fearing Him.<\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><strong><span style=\"font-size:12.0pt\">\u2464<\/span><\/strong><span style=\"font-size:12.0pt\"> Mercy is a criterion for interactions.<strong> <\/strong>Those who are merciful to others will have Allah&rsquo;s mercy bestowed upon them, as the Prophet \ufdfa said, &ldquo;The One in Heaven will not have mercy upon you unless you have mercy on those who are on earth&rdquo;.<sup>44<\/sup><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">It should be noted that:<\/span><\/span><\/span><\/span><\/p>\n<ul>\n<li><span style=\"font-size:11pt\"><span style=\"color:black\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\">The word <em>qist<\/em><strong> <\/strong>appears twenty-seven times in the Holy Quran. In every instance it means <em>equity<\/em> and <em>uprooting inequity<\/em> except for verses 14 and 15 of the chapter of al-Jinn (The Jinn).<\/span><a href=\"#_ftn4\" name=\"_ftnref4\" title=\"\"><sup><sup><span style=\"font-size:11.0pt\"><span style=\"font-family:&quot;Calibri&quot;,sans-serif\">[4]<\/span><\/span><\/sup><\/sup><\/a> <\/span><\/span><\/span><\/li>\n<li><span style=\"font-size:11pt\"><span style=\"color:black\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\">The word <em>aqsitu<\/em><strong> <\/strong>only appears once, in verse 9 of the chapter of al-Hujurat (The Compartments).<\/span><\/span><\/span><\/span><\/li>\n<li><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><em><span style=\"font-size:12.0pt\"><span style=\"color:black\">Tuqsitu<\/span><\/span><\/em><span style=\"font-size:12.0pt\"><span style=\"color:black\"> &ndash; the present tense of the verb to be equitable &ndash;<strong> <\/strong>occurs twice: in verse 3 of the chapter of an-Nisa&rsquo; (Women) and verse 8 of the chapter of al-Mumtahina (The Woman Tested).<\/span><\/span><\/span><\/span><\/li>\n<li><span style=\"font-size:11pt\"><span style=\"color:black\"><span style=\"font-family:Calibri,sans-serif\"><em><span style=\"font-size:12.0pt\">Alqasitun<\/span><\/em><span style=\"font-size:12.0pt\"> &ndash; those who are inequitable &ndash; occurs twice, in verses 14 and 15 of the chapter of al-Jinn (The Jinn).<\/span><\/span><\/span><\/span><\/li>\n<li><span style=\"font-size:11pt\"><span style=\"color:black\"><span style=\"font-family:Calibri,sans-serif\"><em><span style=\"font-size:12.0pt\">Aqsata<\/span><\/em><span style=\"font-size:12.0pt\"> &ndash; the past tense verb meaning <em>uprooted inequity<\/em> &ndash; is used in verse 282 of the chapter of al-Baqarah (The Cow) and verse 5 of the chapter of al-Ahzab (The Confederates).<\/span><\/span><\/span><\/span><\/li>\n<li><span style=\"font-size:11pt\"><span style=\"color:black\"><span style=\"font-family:Calibri,sans-serif\"><em><span style=\"font-size:12.0pt\">Almuqsiteen &ndash; <\/span><\/em><span style=\"font-size:12.0pt\">&nbsp;the equitable &ndash; is used in verse 42 of al-Maiyda (The Table), verse 9 of al-Hujurat (The Compartments) and verse 8 of al-Mumtahina (The Woman Tested).<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">As the term <em>qist<\/em> means having equal shares, it is the ultimate objective of utilizing <em>the balance<\/em>. This is why another term for a scale in Arabic is <em>qistas<\/em> (<\/span><\/span><span dir=\"RTL\" lang=\"AR-SA\" style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\u0627\u0644\u0642\u0633\u0637\u0627\u0633<\/span><\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"color:black\">).<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">Moreover, justice is a universal principle, and equity is the practical application of this principle which is aimed at giving everyone their due rights. This is why the Almighty has ordered the believers to race towards upholding equity in such verses as:<\/span><\/span><\/span><\/span><\/p>\n<ul>\n<li><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3e<\/span><\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"color:black\">Oh you who believe! It is used in the Holy Quran when discussing the issue of reconciling between Muslims when Allah says, <\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3e<\/span><\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"color:black\">Once it has complied, reconcile between them with justice, and be equitable. Surely Allah loves the equitable<\/span><\/span><span style=\"font-size:12.0pt\"><span style=\"font-family:&quot;Sakkal Majalla&quot;\"><span style=\"color:black\">\ufd3f<\/span><\/span><\/span> <span style=\"font-size:12.0pt\"><span style=\"color:black\">(Holy Quran 49: 9).<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\"><span style=\"color:black\">Muslims are ordered to adhere to justice as a principle, and to put it to practice through equity, uprooting injustice, and giving people their due rights.<\/span><\/span><\/span><\/span><\/p>\n<p style=\"margin-left:0in; margin-right:0in\"><span style=\"font-size:11pt\"><span style=\"font-family:Calibri,sans-serif\"><span style=\"font-size:12.0pt\">It should be noted that <em>justice<\/em> (<em>adl) <\/em>and <em>equity (qist)<\/em> have slightly different meanings when used together, while they have the same general meaning when considered independently. When <em>equity<\/em> alone is used, it refers to the general concept of justice &ndash; uprooting inequalities and giving people their due rights. However, when <em>justice<\/em> and <em>equity<\/em> are used in the same context, the latter is intended to mean putting an end to inequity. When <em>justice<\/em> is used alone, it means doing justice and uprooting inequity. When it is used with <em>equity<\/em>, however, <em>justice<\/em> refers to the overarching principle.
